M&S represents Indiana Medicaid recipients in a proposed class action against IBM, Affiliated Computer Services (ACS), and other companies who contracted with the state of Indiana to privatize its Medicaid system. Plaintiffs allege that Defendants failed to process their appeals contesting the discontinuation of benefits in a timely manner. As a result, Plaintiffs and many others lost their Medicaid insurance and the essential medical services it provides. Plaintiffs also allege that Defendants terminated Medicaid coverage without considering whether recipients were entitled to continued benefits under other Medicaid eligibility categories, in violation of a state consent decree.
Plaintiffs filed their complaint in 2011, and the parties are engaged in discovery.
