Gilliam v. Bank of America

Mehri & Skalet represented a District of Columbia home owner who was facing foreclosure after Bank of America (“BofA”), without notice, held his payments (all timely) in a suspense account for over a year.  BofA refused to apply the borrower’s payments to his loan, refused to report his interest payments to the IRS which effectively denied him a substantial tax deduction, and added unwarranted late fees and other charges that drove the homeowner into foreclosure.  After hours of phone calls to BofA by the borrower, and calls and letters by a housing counselor and legal counsel – all to no avail – the homeowner filed suit against BofA in 2010 in D.C. Superior Court.  The case was successfully settled in 2011.
