Summary In August 2007, Mehri & Skalet, PLLC filed a class action complaint against American Standard Companies, Inc., on behalf of Plaintiff Stephen Laney, and a putative class of customers who purchased the “Champion” model toilet.
The Champion toilet features a proprietary flushing mechanism that American Standard represents is “the best thing to happen to toilets since indoor plumbing.” The Complaint alleges that the flushing mechanism was defectively designed, and as a result, it is prone to break and leak. Despite the fact that the toilet comes with a 10-year “worry-free” warranty, American Standard has failed to fix the problem or to cover the cost of repairs and bills from wasted water.
Plaintiff has brought claims for breach of warranty, breach of contract, unjust enrichment, and a claim under the New Jersey Consumer Fraud Act.
