SR-22 forms are forms that insurance companies must file with the state on behalf of drivers who have had serious violations. The driver who has had the violation must also carry a copy of the SR-22 form for three years. Illinois law prohibits insurers from charging for the filing of the SR-22 form: the insurer can charge for the underlying violation itself, but it can not charge an additional fee for the filing of the SR-22 form. Notwithstanding this language, for more than a decade State Farm has been charging both for the underlying violation and also for the filing of an SR-22 form: in some cases, it charges as much as 50% of the insurance premium for filing the SR-22.
